Real Property Cases Resolved
Flooding/erosion/inverse condemnation. Mr. Yates represented a water district in various cases where landowners contended that the district should pay for damage to their property due to flooding and bank erosion. Mr. Yates researched the somewhat confusing field of inverse condemnation for flooding and public works projects and was able to demonstrate that while landowners could recover in certain, specific circumstances, their damage did not qualify.

Purchase and Sale/Disclosure. Mr. Yates represented sellers in mold disclosure cases and favorably settled the matters for his clients in mediation.

Boundary/title/easements. In a complex project in which two municipalities and a major university were attempting to build housing and improve the road corridors for the new traffic, Mr. Yates worked closely with property agents to address boundary, title and condemnation issues so the project could move forward.

Subdivisions/rights of way/CalTrans. A developer had proposed a development of two lots in an expensive area of the coastal zone where railroad, and CalTrans rights of way and public access easements posed conflicts that could have resulted in expensive litigation. Mr. Yates worked with property specialists, the transportation entities and the public agencies to develop alternatives that served the needs of the competing groups.
